NEWSELA KEVIN QUINN READING CHALLENGE
NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. MAKING A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. The Newsela Kevin Quinn Reading Challenge (the “Challenge”) is sponsored by Newsela, Inc., having an address of 519 8th Avenue, 21st Floor, New York, NY 10001 (“Sponsor” or “Newsela”) with Prizes (defined below) provided by The Kevin Quinn Foundation (“Prize Provider”) and Newsela.
Subject to these Official Rules, the Challenge is open to elementary and middle schools in the Los Angeles Unified School (LAUSD) District, California (each, a “LAUSD School”). All students in the Los Angeles Unified School (LAUSD) District, California who are registered Newsela users may participate (each a “Participating Student”) to help your LAUSD School win one of the Prizes set forth below. THE CHALLENGE IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW OR WHERE BONDING, REGISTRATION, OR OTHER REQUIREMENTS WOULD BE REQUIRED BUT HAVE NOT BEEN MET, OR WHERE THE METHODS OF ENTRY SET FORTH BELOW WOULD BE DEEMED CONSIDERATION. ALL APPLICABLE FEDERAL, STATE AND LOCAL LAWS APPLY. LAUSD Schools shall not allow, encourage, or permit participation by students unless the LAUSD School has obtained all necessary consent from such student’s parent and/or legal guardian for use of Newsela’s services.
The Challenge begins at 12:00 am (midnight) Eastern Time on 04/06/16 and ends at 11:59 pm Eastern Time on 05/04/16 (“Entry Period”).
HOW TO PARTICIPATE
No purchase or payment is necessary to participate in the Challenge. During the Entry Period, Participating Students can earn points (“Points”) for their LAUSD School by taking Newsela quizzes on Newsela’s website or mobile services (the “Newsela Services”). Participating Students will earn 1 Point for each quiz taken on the Newsela Services. Participating Students will also earn 1 additional Point for each correct quiz answer on the Newsela Services. Furthermore, Participating Students will receive 2 Points for taking a quiz from any of the articles in the “Taking on Climate Change” Text Set and 2 Points for every correct answer selected by the Participating Student in such text set.
The LAUSD School with the highest Reading Challenge Score (defined below) at the end of the Challenge will win a visit from entertainer Kevin Quinn.
Reading Challenge Score = total Points earned by Participating Students divided by number of total Students enrolled at the LAUSD School, including students who are not Participating Students.
*Student Enrollment numbers will be based off of Los Angeles Report.
Sponsor expressly reserves the right to disqualify any entries or participation that it believes in good faith are generated by automated means or scripts, in violation of these Official Rules or otherwise results from any unsportsmanlike or disruptive conduct, and all such associated entries, including all Points accumulated as a result of such conduct (as determined by Sponsor in its sole discretion) shall be void.
The available prizes (“Prizes”) are as follows:
- First Place Winner: The LAUSD School with highest Reading Challenge Score at the end of the Challenge will win a visit from entertainer Kevin Quinn.

- Third Place Winner: More information to follow, stay tuned.
Decisions of the Sponsor are final and binding with respect to all matters related to the Challenge. In no event shall the Sponsor or Prize Provider be obligated to award any prizes other than the Prizes specified in these Official Rules. The Prizes are non-transferable and no substitutions (including, without limitation, for cash) are permitted, except that Sponsor and Prize Provider reserve the right to substitute a prize of equal or greater monetary value for any Prize, or any portion thereof, if such Prize, or any portion thereof, should become unavailable for any reason. To receive a complete list of winners or a copy of the Official Rules, within six (6) months after the end of the Entry Period, send a self-addressed stamped envelope to Newsela Kevin Quinn Reading Challenge Winner’s List, 519 8th Avenue, 21st Floor, New York, NY 10001.
Sponsor will identify 3 winners (1 First Place, 1 Second Place, and 1 Third Place) based on total Reading Challenge Scores, in accordance with the terms and conditions set forth in these Official Rules.
The Challenge will be conducted under the supervision of the Sponsor. The decisions of the Sponsor are final and binding in all matters relating to the Challenge. The winning LAUSD Schools will be notified on or around 05/04/16 by email and via social media; provided, however, that Sponsor reserves the right to determine an alternate method of notification. Sponsor will also post a list of winning LAUSD Schools on its blog located at blog.newsela.com. Sponsor will work with the First Place LAUSD School to schedule Kevin Quinn’s school visit, but details of such visit shall be ultimately determined by Sponsor and Prize Provider, in their sole discretion.
GENERAL CONDITIONS AND RELEASES
When applicable, a winning LAUSD School may be required to execute and return (and winning may be conditioned upon the winner executing and returning) to Sponsor an Affidavit of Eligibility and a Liability and/or Publicity Release provided by Sponsor to be eligible for the Prize, or an alternate winner may be selected.
Unless prohibited by applicable law, your entry into the Challenge and/or acceptance of a Prize constitutes permission to use photographs, images, voices, and other identifying information concerning the LAUSD School’s participation in the contest, in perpetuity and without any compensation to you or any review or approval rights, notifications, or permissions.
An entrant, participant, or winner may be disqualified from the Challenge if he, she, or it fails to comply with each provision of these Official Rules, as determined in the sole discretion of the Sponsor. Participation in the Challenge is at entrant’s and/or participant’s own risk. Neither Sponsor nor Prize Provider shall be liable for: (1) failed, returned or misdirected notifications based on inaccurate information provided by the winner in connection with an entry; (2) entries and responses to winner notifications which are lost, late, incomplete, illegible, unintelligible, postage-due, misdirected, damaged or otherwise not received by the intended recipient in whole or in part or for computer or technical error of any kind; (3) any electronic miscommunications or failures, technical hardware or software failures of any kind, lost or unavailable network connections, or failed incomplete, garbled or delayed computer transmissions which may limit an entrant's ability to participate in the Challenge; (4) any technical malfunctions of the telephone network, computer online system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile device related to or resulting from downloading any of Sponsor’s products or services or otherwise in connection with this Challenge; or (5) any warranty with respect to any Prize or any component thereof. THE PRIZES ARE AWARDED “AS IS” AND SPONSOR AND PRIZE PROVIDER DO NOT MAKE ANY, AND HEREBY DISCLAIM ANY AND ALL, REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE PRIZES.
NOTWITHSTANDING ANYTHING ELSE HEREIN OR OTHERWISE, SPONSOR, PRIZE PROVIDER AND/OR THEIR VENDORS SHALL NOT BE LIABLE OR OBLIGATED WITH RESPECT TO ANY SUBJECT MATTER OF THIS AGREEMENT OR UNDER CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY FOR (A) ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF REVENUE, GOODWILL, OR ANTICIPATED PROFITS), (B) DATA LOSS OR COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, AND/OR (C) ANY MATTER BEYOND SUCH PARTIES’ REASONABLE CONTROL.
By entering or participating in the Challenge, the winning LAUSD School agrees to and hereby does release and hold Sponsor, Prize Provider, and each of their respective parents, subsidiaries and affiliated entities, directors, officers, employees, attorneys, agents, and representatives (the “Released Parties”) from any damage, injury, death, loss, claim, action, demand, or other liability (collectively, “Claims”) that may arise from your acceptance of any Prize or your participation in this Challenge. Entrants hereby waive California Civil Code Section 1542 or any other similar law that says in substance: “A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor.” Any person attempting to defraud or in any way tamper with this Challenge may be prosecuted to the full extent of the law. Sponsor reserves the right to modify these Official Rules in any way or at any time. Sponsor reserves the right, in its sole discretion, to cancel or suspend this Challenge should viruses, bugs or other causes beyond their control corrupt the administration, security or proper operation of the Challenge. In the event of cancellation or suspension, Sponsor shall promptly post a notice on Sponsor’s website to such effect. This Challenge shall be governed by New York law, without regard to conflicts of laws provisions. By participating in this Challenge, you agree that any dispute or litigation arising from or relating to this Challenge shall be determined by binding arbitration only in New York, NY, by and under the Streamlined Arbitration Rules and Procedures of JAMS, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Notwithstanding the foregoing, Sponsor may seek equitable relief in any court of competent jurisdiction. If any provision of these Official Rules is held to be illegal or unenforceable, such provision shall be limited or eliminated to the minimum extent necessary so that these Official Rules otherwise remain in full force and effect and enforceable.
